1) No guarantee of returns

Expected returns are estimates based on case assumptions and historical patterns. Insurance processing, denials, offsets, and disputes can delay, reduce, or eliminate returns.

2) Liquidity and transferability

Investments may be illiquid. Secondary transfers may be limited or unavailable. You should be prepared to hold your position to maturity or resolution of the underlying claim.

3) Verification and underwriting limits

While cases are reviewed for validity and insurance coverage, errors or fraud can occur. Verification does not eliminate risk of nonpayment, partial payment, delays, or disputes with insurers or providers.

You are exposed to the operational reliability of EMS‑X and its partners (e.g., custody, KYC, payment rails). Downtime, cyber events, data issues, or vendor failures may impact outcomes or timing.

6) Insurance and medical risks

Case outcomes depend on medical necessity determinations, policy limits, exclusions, deductibles, coordination of benefits, and insurer solvency. Cross‑border care can add complexity and delay.

7) Geographic, FX, and political risks

Cross‑border transports and care introduce currency, jurisdictional, and political risks that can affect timing and recoveries.

8) Conflicts of interest

9) Tax treatment

Tax outcomes vary by investor and jurisdiction. EMS‑X does not provide tax advice. Consult your advisor.

10) Not an offer in restricted jurisdictions

Availability may be limited by law. Access does not constitute an offer or solicitation where prohibited.

11) Recordkeeping

Consents and communications may be retained under applicable recordkeeping requirements (e.g., WORM if handled by a broker‑dealer partner).
